Criminal Law is a cornerstone of law students' education. It involves studying the detail of particular offences - including murder, rape, assault and drug trafficking - as well as certain defences, such as 'insanity' and self-defence. Underlying these topics is an analysis of what the criminal law calls
mens rea, or the guilty mind. Since the criminal laws studied are contained in Tasmanian and Australian legislation, the unit provides foundational skills in statutory interpretation, which are highly valued in various professional settings. Naturally the unit may provoke your sense of justice. This might particularly occur when - in the practical problem-solving exercises - you determine the guilt or innocence of fictitious characters involved in hypothetical scenarios. However, this unit equally invites you to consider the (a) the social context of crime and (b) ethical obligations of criminal lawyers.

Tutorial participation (15%); Tutorial papers (10%); Research Exercise (Legislation) (5%); Semester 1 Multiple choice test (5%); Semester 1 (LAW225 Criminal Law A) closed-book exam (15%); Semester 2 (LAW226 Criminal Law B) 3-hr closed-book exam (50%).
TEACHING PATTERN: 3x 50-min lectures weekly (26 wks), 50-min tutorial fortnightly (24 wks) over the year for LAW225 and LAW226.
