Introduces students to some of the basic features of the Federal and State Constitutions and of the Australian federal system. Topics covered include: The basis of judicial review; The powers of state parliaments; Parliamentary control of government finances; The interpretation of Commonwealth powers; The characterisation of Commonwealth laws; Inconsistency between Commonwealth and State laws; Immunity of Commonwealth and State Governments from the laws of the other; Sections 81, 83 and 96 and Commonwealth State financial relations; Commonwealth State cooperative schemes including referrals of power and request and consent legislation under s 51(37) and (38).
The unit has a strong emphasis on the study of leading High Court cases and aims to develop student abilities to analyse these cases.
TEACHING PATTERN: 2 x 50 minute lectures weekly, 1 x 100 minute tutorial fortnightly (13 wks)
